Privacy Policy pursuant to art. 13 of the GDPR

According to art. 13 of the European Data Protection Regulation No. 2016/679 (GDPR), we wish to inform you that, should your profile prove of interest to us, the personal data you provide will be collected and stored in a special database, both in paper and electronic form, kept exclusively for the purpose of selecting personnel, based/founded on the execution of pre-contractual measures adopted at the request of the data subject.

Purposes and legal grounds for processing

Your data is processed, without your prior consent, for the following Service Purposes:

- Executing the contract or fulfilling pre-contractual obligations pursuant to art. 6(1)(b) of the GDPR, in particular:

  • participating in the selection process for which you sent your data;
  • ensuring that the personnel selection process (e.g. management and assessment of applications) is carried out correctly;
  • contacting you to invite you to a job interview;
  • contacting you to give feedback on the outcome of the application assessment processes;
  • enabling the fulfilment of any pre-contractual and contractual obligations necessary to establish an employment relationship;
  • storing your CV in the relevant database in order to bear it in mind also for future positions of potential interest requiring professional experiences and qualifications similar to yours;

- Pursuing a legitimate interest of the Data Controller pursuant to art. 6(1)(f) of the GDPR, in particular:

  • including your application in the statistical analyses we carry out involving the selection process;
  • preventing or exposing fraudulent use or abuse of the website;
  • fulfilling obligations provided for by law, regulations, Community legislation or an order of the Authorities;
  • exercising the rights of the Data Controller, such as the right to defence in court.

The data marked with an asterisk (*) are necessary to participate in the personnel selection process and to enter into any employment contract. Failure to provide this data will make it impossible for us to include you in the selection process.

Any sensitive data under art. 9 of the GDPR (e.g. health status; fitness for the job; membership in protected categories; union memberships; etc.) provided via the form or included in your CV will be immediately deleted in the absence of your explicit written consent to their being processed by our Company. If you consent to our processing this data, the legal basis for such processing is detailed in art. 9(2)(a) of the GDPR.

Data retention period

If your profile should not prove compatible with the positions currently open, we will store it in our archives for the time strictly required to achieve the above mentioned purposes, and in any case for at most 24 months.

Access to, location and communication of your data

Only Human Resources, personnel selection officers and other departments concerned by the selection process shall be allowed to access your data.

Data subject to processing will not be transferred outside the European Union or communicated to third parties outside our structure, except as required by law (e.g. your data may be communicated without your consent to the police or the judicial authorities at their specific request).

Rights of the data subject

Please note that as the data subject you have the rights laid down in Articles 15 to 22 of the GDPR, i.e. the right of access, the right to rectification, the right to erasure, the right to restriction of processing, the right to data portability, the right to object, and the right not to be subject to a decision based solely on automated processing; to exercise these rights, please email the Morellato Group Privacy Officer at: privacy@bluespirit.com. Moreover, if you have given your consent to one or more specific purposes, you have the right to withdraw such consent at any time without prejudice to data processing operations carried out based on consent given prior to the revocation.
